Aptamil Follow on Milk Ready to Drink Picnic Event Terms & Conditions

These Terms and Conditions (“Terms”) apply to your registration for and participation in our Aptamil Follow on Milk Ready to Drink Picnic event. By registering, participating in, or attending this event, you acknowledge that you have read, understand, and agree to the Terms between you and the applicable Nutricia entity hosting the event, including our subsidiaries and affiliates.

The Terms apply to bookings received for the Aptamil Follow on Milk Ready to Drink in-person event.

These Terms apply once a completed booking has been submitted via Eventbrite.

• Event- Aptamil Follow on Milk Ready to Drink Picnic Event, 24th June 2023, Regent’s Park

• Nutricia- Nutricia Limited, incorporated in England and Wales with company number 275552 whose registered office is at Newmarket Avenue, Whitehorse Business Park, Trowbridge, Wiltshire BA14 0XQ

• Nutricia Intellectual Property- All intellectual property owned by or licensed to Nutricia including, but not limited to, patents, utility models, rights to inventions, copyright and neighbouring and related rights, trade marks, logos, brand names, business names and domain names, website content, rights in get-up and trade dress, goodwill and the right to sue for passing off, rights in designs, rights in computer software, database rights, rights to use, any documents and materials displayed at or generated from the Event, confidential information and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, any rights and all similar or equivalent rights or forms of protection that subsist or will subsist now or in the future in any part of the world.

1. General

Event information including agenda, speakers (where applicable) can be found on the events listing page on Eventbrite.

One ticket allows admission foronebaby aged 6-12 months on the day of the event, and a maximum oftwoadults.

Groups must arrive together to be permitted entry.

Adults cannot attend without a baby aged 6-12 months, and all children must be accompanied by an adult (aged 18 or above).

Due to regulations surrounding promotion of Follow-On Formula, pregnant women or babies under the age of 6 months are not allowed to attend.

All attendees must have a valid ticket to be permitted entry. Additional attendees will not be permitted.

Nutricia reserves the right to refuse the entry to the Event at its discretion, or to request an attendee to leave the Event.

2. Data Protection

Nutricia is committed to protecting your right to privacy. By booking to attend the Event, you agree to Nutricia and Nutricia’s processors acting on its behalf (namely third-party event organisers) to storing and using the data provided for event preparation and production including, but not limited to, coordinating logistics, registrations and attendance lists and providing associated support with your attendance at the event. We may use your email address in connection with the Event, for instance but not limited to, to provide you with advance or follow-up information related to the Event.

3. Liability

To the maximum extent permitted by law, Nutricia’s liability in respect of any claim, whether in contract, tort (including negligence), for any loss or damage arising under or in connection with these Terms however arising, breach of statutory duty, or otherwise, will in no circumstances exceed the amount of the booking fee, if any.

Nutricia accepts no responsibility in respect of any claim, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for indirect or consequential loss or any loss suffered by any third party.

Nothing in these Terms shall exclude or limit the liability of Nutricia for:

(i) death or personal injury caused by negligence; or

(ii) fraudulent misrepresentation or other fraud.

4. Confirmation of Bookings

Confirmation of bookings will be sent to the originator of the booking via Eventbrite.

If you have not received confirmation of the booking within an hour of booking, please contact Eventbrite.

5. Intellectual Property

You acknowledge that ownership of the Nutricia Intellectual Property used at or in connection with the Event or otherwise, including any adaptations or modifications of such Nutricia Intellectual Property shall remain vested in Nutricia and/or its licensors (as the case may be).

Nutricia reserves the right to use the Nutricia Intellectual Property, which for the avoidance of doubt shall include any intellectual property arising from content and/or materials generated from the Event for any purpose at its sole discretion.

You will not acquire any rights of any nature in the Nutricia Intellectual Property or goodwill therein, or any intellectual property arising from content and/or materials generated from the Event, and any use of the Nutricia Intellectual Property shall inure to the benefit of Nutricia.

6. Cancellations/Substitutions

Event cancellation

At any point Nutricia reserves the right to change the content, agenda, dates, times, platform or listed speakers as necessary and to postpone/cancel the event, with no liability or recourse.

If an event is postponed or cancelled, Nutricia will contact you at the earliest opportunity to advise and may arrange a refund of the Event booking fee if applicable, or may hold the payment and allocate it to the new date in the case of a postponed event.

Attendance cancellation

If you can no longer attend the event, we request you to cancel via Eventbrite as soon as possible so other people can attend.

Substitutes are not permitted.

7. Photography and videography

摄影、拍摄和音频/ video recording may be carried out during the event. By attending the event, you (i) consent to being filmed, recorded and/or photographed and (ii) grant Nutricia the right to use your picture, image, voice, sound recording and likeness without payment for use, in any resulting media (printed or electronic) including use on Nutricia websites, in social media, for promotion of and advertising by Nutricia worldwide and in perpetuity.

8. Disclaimer

Nutricia make no representations or warranties about the accuracy or suitability of information provided or the opinions of the presenter(s). Speakers may receive a gratuity for participating in the event however, all opinions expressed by the speaker are their own clinical/professional opinions.

9. Force Majeure

Nutricia shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lockouts, accidents, war, fire, breakdown of plant or machinery.

10. Severance

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
